Customer Terms and Conditions of Hire
1. Definitions
'Company' means Beesley & Fildes Ltd. 'Customer' means the person or organisation hiring equipment. 'Equipment' means all tools, plant, machinery and accessories supplied by the Company. 'Hire Period' means the period from dispatch until returned and accepted by the Company.
2. Basis of Hire
All equipment is hired subject to these Terms and Conditions. By placing an order, the Customer agrees to be bound by them.
3. Hire Charges and Payment
Hire charges apply for the full hire period. Invoices are payable in accordance with agreed credit terms. Overdue accounts may incur interest under the Late Payment of Commercial Debts legislation.
4. Delivery and Collection
Delivery and collection charges may apply. Safe access must be provided by the Customer.
5. Customer Responsibilities
Equipment must only be used by competent persons for its intended purpose. The Customer is responsible for the security, safe use and condition of the Equipment throughout the Hire Period.
6. Inspection and Acceptance
Any shortages, defects or damage must be reported within 24 hours of delivery.
7. Breakdown and Repairs
Faults must be reported immediately. No repairs may be carried out without prior authorisation.
8. Loss, Damage and Theft
The Customer is responsible for all loss, theft or damage during the Hire Period and must notify both the Police and Beesley & Fildes immediately in the event of theft.
9. Insurance
Customers should maintain adequate insurance cover for hired equipment.
Insurance Excess
The Customer shall be responsible for paying any insurance excess applicable in respect of any loss of, theft of, or damage to the hired plant or equipment during the Hire Period. Payment of the insurance excess shall not limit the Customer's liability for any uninsured losses or damage arising from negligence, misuse or breach of these Terms and Conditions.
10. Ownership
Ownership of all equipment remains with the third-party tool hire company at all times. Beesley & Fildes Ltd acts solely as the hire agent and no ownership or title to the equipment passes to the Customer under any circumstances.
11. Access and Recovery
The Company may recover equipment where these Terms have been breached or payment remains outstanding.
12. Health and Safety
The Customer shall comply with all applicable UK Health & Safety legislation including PUWER and LOLER where applicable.
13. Limitation of Liability
The Company shall not be liable for indirect or consequential losses.
14. Termination
The Company may terminate the hire agreement for non-payment, misuse of equipment or breach of these Terms.
15. Force Majeure
The Company shall not be liable for delays caused by events beyond its reasonable control.
16. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
